BMPs:
SWPPP management should be part of your greater risk management plan.
- BMPs are "Best Management Practices", the actual devices specified by your SWPPP that will reduce sediment runoff and the escape of pollutants such as trash or material debris from your job site.
- BMPs act as your on site "pollution filters" trapping and stopping potentially hazardous and dangerous materials from entering into our water ways. BMPs such as wattles and silt fence work great to control the loss of sediment and for erosion control.
- BMPs alone will not keep you compliant; you must use them in conjunction with a SWPPP.
- BMPs must be properly installed and maintained throughout the life of the project.
- Inspections are required every 14 days or within 24 hours of a rain event which produces .5" or more of rain. You may also conduct inspections every 7 days. We can help you decide which is best for your job site.

Q: Who is responsible for obtaining a SWPPP for my residential, commercial, or public
works' project?
A: A company or person(s) that will act as an "Operator" with operational control over the construction
plans and specs. An "Operator" may also have control of the day to day activities at a project.
The Project "Owner" and "General Contractor" may also seek coverage under the SWPPP or Permit
depending on the scope of the project. Both may or may not apply for coverage and both may also
qualify for "Operator" status depending on the scope of the project and hierarchy of the construction
contract.
Please note that you can have "Multiple Operators" for the same site.
Under most circumstances the General Contractor or Builder will hire us to draft & implement the
SWPPP. Architects and Civil Engineers may also call us so that we are aware of the project in the early
stages, which allows for better timing, implementation, and delivery of the SWPPP.
Q: Is NOT having a SWPPP in place a violation of Federal law?
A: Yes, as of March 10, 2003, all projects (residential, commercial, linear, utility, and road) of 1 to 5 acres
(or smaller if they are part of a larger plan of development or scale) must comply with
the National Pollutant Discharge Elimination System (NPDES). Please also read
about local requirements under the Clean Water Act.
Q: Who should receive SWPPP training?
A: All Project Managers, Project Engineers, Project Superintendents, General
Contractors, Project Owners, Developers, Architects, Civil Engineers.
General knowledge should be granted to Realtors, Mortgage Brokers, Business Bankers, and Title
Insurance Companies.
It is important to remember that a penalty can convert to a lien against the stated
property if it is not paid therefore putting the mortgage company in a negative equity
position.
